Warranty

GREENSTREAK warrants to the Buyer that this product will comply with the specifications provided by GREENSTREAK  in the then current version of (a) that particular Product’s specifications, (b) Supplier’s brochures and sales literature applicable to that particular Product, and (c) statements made on GREENSTREAK’S packaging for that particular Product (collectively, the “Product Representations”).  Except as expressly agreed by GREENSTREAK in writing customary deviations from quality shall not be a basis for a claim. 
Except as expressly provided otherwise herein, GREENSTREAK has made no and disclaims all warranties, expressed or implied, including the warranties of merchantability or fitness for a particular purpose. 
The exclusive remedies of the Buyer and the limited liability of GREENSTREAK from any and all losses or damages resulting from use of this product (including breach of contract, tort or other basis at law or in equity) shall be either the full refund of the purchase price to Buyer of this product, or the replacement of the quantity of product purchased by the Buyer – at the election of GREENSTREAK.  In no event shall GREENSTREAK be liable for any incidental, coincidental or punitive damages.  The Buyer and all users of the product are deemed to have accepted the terms of this limited warranty and may not be varied in any way by any verbal or written agreement.
